Terms of service
Overview
Welcome to CourtShield! The words “we”, “us”, and “our” refer to CourtShield. CourtShield operates this store and website, including all related information, content, features, tools, products, and services in your orders, in order to provide you, the customer, with a curated shopping experience (collectively, the “Services”). CourtShield is supported by Shopify, which enables us to provide the Services to you.
The following terms and conditions, together with any policies referenced herein (collectively, the “Terms of Service” or “Terms”), describe your rights and responsibilities when using the Services. Please read the Terms carefully, as they contain important information about your legal rights, including disclaimers and limitations of liability.
By accessing, using, or interacting with the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to the Terms of Service or the Privacy Policy, please do not use or access the Services.
Section 1 – Access and Accounts
By agreeing to these Terms of Service, you represent that you are at least the age of majority in the state or province of your residence, and that you have given us your consent to allow any of your minor dependents to use the Services on devices that you own, purchase, or manage.
To use the Services, including browsing our online store or purchasing any products or services, you may be required to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide in our store is true, accurate, current, and complete, and that you have all rights necessary to provide such information.
You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person.
Section 2 – Our Products
We make every effort to display our products and services accurately in our online store. Please note, however, that the colors or appearance of products may differ from what is displayed on your screen, depending on the type of device you use to access the store and your device’s settings and configuration.
We do not warrant that the appearance or quality of any product or service you purchase will meet your expectations, or that it will be identical to the description presented in our online store.
We may, at our discretion, change all product descriptions at any time without notice. We reserve the right to discontinue the sale of any product at any time, and to limit the quantities of any products or services that we offer to any person, geographic region, or jurisdiction on a case-by-case basis.
Section 3 – Orders
When you submit an order, you make an offer to purchase. CourtShield reserves the right, at its sole discretion, to accept or reject your order for any reason. Your order is not accepted until CourtShield confirms acceptance. We must receive and process your payment before we accept your order. Please review your order carefully before submitting it, because after an order is accepted CourtShield may be unable to accommodate requests for cancellation. If we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number you provided at the time the order was placed.
Products you purchase may only be returned or exchanged in accordance with our Refund Policy.
Your purchase is for your personal or household use only and may not be used for commercial resale or export.
Section 4 – Prices and Billing
Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is submitted and will be listed in your order confirmation email. Unless expressly stated otherwise, published prices do not include taxes, shipping, handling fees, customs duties, or import charges.
Prices published in our online store may differ from prices offered in physical stores, other online stores, or stores operated by third parties. We may, from time to time, offer service promotions that may affect pricing; such promotions are governed by separate terms and conditions in addition to these Terms. If there is a conflict between the promotional terms and these Terms, the promotional terms will govern.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made in our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that: (i) the credit card information you provide is true, correct, and complete; (ii) you are duly authorized to use that credit card for the purchase; (iii) charges incurred by you will be honored by your credit card company; and (iv) you will pay the charges you incur at the published prices, including shipping and handling fees and all applicable taxes, if any.
Section 5 – Shipping and Delivery
We are not responsible for delays in shipping and delivery. All delivery times are estimates only and cannot be guaranteed. We are not responsible for delays caused by carriers, customs processing, or events beyond our control. Title and risk of loss for products pass to you upon our transfer of the products to the carrier.
Section 6 – Intellectual Property
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, videos, and audio, and their design, selection, and arrangement, are owned by CourtShield, its affiliates, or its licensors, and are protected by United States and foreign patent, copyright, and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material in the Services without our prior written consent. Except as expressly stated herein, nothing in these Terms grants, or should be construed as granting, you any license or other right to use any patent, trademark, copyright, or other intellectual property of CourtShield, Shopify, or any third party. Unauthorized use of the Services may violate federal and state intellectual property laws. CourtShield reserves all rights not expressly granted in these Terms.
The CourtShield name, logo, product and service names, designs, and slogans are trademarks of CourtShield or its affiliates or licensors. You may not use such marks without CourtShield’s prior written permission. The Shopify name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans in the Services are the trademarks of their respective owners.
Section 7 – Optional Tools
As part of the Services, you may be given access to customer tools provided by third parties, which we neither monitor nor have any control or input over.
You acknowledge and agree that such access to tools is provided on an “as is” and “as available” basis, without any warranties, representations, or conditions of any kind and without any endorsement. We are not liable for any liability arising from or relating to your use of optional third-party tools.
Your use of optional tools offered through the website is entirely at your own risk and discretion, and you should ensure that you are familiar with, and agree to, the terms under which the relevant third-party provider provides its tools.
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features will also be considered part of the Services and governed by these Terms of Service.
Section 8 – Third-Party Links
The Services may contain content and hyperlinks to websites provided or operated by third parties (including any embedded third-party features). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites that you choose to access. If you decide to leave the Services to access such materials or third-party websites, you do so at your own risk.
We are not liable for any harm or losses related to your access of any third-party website, or your purchase or use of any products, services, resources, or content on or through any third-party websites. Before engaging in any transaction, please review the third party’s policies and practices carefully and make sure you understand them fully. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third party.
Section 9 – Relationship with Shopify
CourtShield is supported by Shopify, which enables us to provide the Services to you. However, any sales and purchases made through our store are made directly with CourtShield. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and CourtShield, including any injury, damage, or loss arising from the purchase of products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liability arising from or related to your purchases and transactions with CourtShield.
Section 10 – Privacy Policy
All personal information collected through the Services is governed by our Privacy Policy; certain personal information may also be subject to Shopify’s privacy policy. By using the Services, you acknowledge that you have read the Privacy Policy.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services. Information you submit to the Services will be transmitted to, and shared with, Shopify and third parties (which may be located in countries other than your country of residence) in order to provide the Services to you. Please see our Privacy Policy to learn more about how we, Shopify, and our partners use your personal information.
Section 11 – User Comments, Feedback and Other Submissions
If you submit, upload, post, send by email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial purposes. For example, we may use the rights granted under this license to operate, provide, evaluate, enhance, improve, and promote the Services, and to perform our obligations and exercise our rights under these Terms of Service.
You also represent and warrant that: (i) all Feedback and all rights necessary in it are owned by you; (ii) you have disclosed any compensation or rewards you received for submitting Feedback; and (iii) your Feedback complies with these Terms. We are under no obligation now or in the future to (1) keep your Feedback confidential; (2) pay compensation for your Feedback; or (3) respond to your Feedback.
We may, but have no obligation to, monitor, edit, or remove Feedback that we determine, in our sole discretion, to be unlawful, offensive, threatening, defamatory, libelous, pornographic, obscene, or otherwise objectionable, or that violates any party’s intellectual property or these Terms of Service.
You agree that your Feedback will not infringe any third party’s rights, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You further agree that your Feedback will not contain defamatory or otherwise unlawful, abusive, or obscene content, or any computer virus or other malicious software that could in any way affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy. We are not responsible for any Feedback posted by you or any third party.
Section 12 – Errors, Inaccuracies, and Omissions
Occasionally there may be information in the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders, at any time and without prior notice (including after you have submitted your order), if any information is inaccurate.
Section 13 – Prohibited Uses
You may access and use the Services only for lawful purposes. You may not access or use the Services: (a) for any unlawful or malicious purpose; (b) in violation of any international, federal, provincial, or state regulation, rule, law, or local ordinance; (c) to infringe or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate against any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter”, “spam”, or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or that we determine may harm CourtShield, Shopify, or users of the Services or expose them to liability.
Additionally, you agree not to: (a) upload or transmit viruses or any other malicious code that affects the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) launch spam, phishing, pharming, or spoofing attacks against the Services; (e) use any robot, spider, scraping tool, data gathering and extraction tools, automated device or program, AI tools (for example, agentic AI), or automatic or manual means to access the Services; or (f) interfere with, bypass, or circumvent security or authorization features, robot exclusion headers, or other measures we use to restrict access to the Services. If we determine that you have violated any part of these Terms, we reserve the right to suspend, deactivate, or terminate your account at any time without notice.
Section 14 – Agents
14.1 This Section (the “Agent Terms”) applies if you use, permit, enable, or cause the deployment of agents to access, use, or interact with the Services. “Agents” means any software or service that acts on behalf of a person or entity, or at its direction, and takes autonomous or semi-autonomous actions on behalf of a person or using a person’s device, without direct supervision.
14.2 No Agent may access, use, or interact with the Services unless it identifies itself at all times and operates in strict compliance with the requirements of Section 14.4 below. In addition, no Agent may access, use, or interact with the Services if we ask the Agent to avoid such access, use, or interaction.
14.3 We may limit (including through technical measures) whether, and how, Agents may access, use, and interact with the Services.
14.4 Agents must: (i) indicate in all HTTP/HTTPS requests that the request originates from an Agent and disclose the Agent’s name by including the following in the request’s user-agent string: “Agent/[agent name]”; (ii) not conceal or obscure the fact that any access, use, or interaction is from an Agent, including by (a) mimicking human behavior or interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from human use; (iii) respond truthfully to any questions or prompts seeking to determine whether an interaction originates from a human or a computer; and (iv) not circumvent or otherwise avoid any measures intended to block, restrict, modify, or control whether and how Agents may access, use, or interact with the Services.
Section 15 – Termination
We may terminate this agreement or your access to the Services (or any part thereof) at any time, at our sole discretion, without notice, and you remain liable for all amounts due up to and including the date of termination.
The following provisions survive termination: Intellectual Property, Feedback, Termination, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any provisions which by their nature should survive termination.
Section 16 – Disclaimer of Warranties; Limitation of Liability
Information displayed or offered through the Services is for general reference only. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We are not liable for any liability arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of its contents.
Except as expressly stated by CourtShield, the Services and all products offered through the Services are provided on an “as is” and “as available” basis, without any representations, warranties, or conditions of any kind, express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant or represent that your use of the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow the exclusion of implied or other warranties, so the above disclaimer may not apply to you.
Section 17 – Limitation of Liability
To the maximum extent permitted by law, in no event shall CourtShield, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors, or any of those persons for Shopify and its affiliates, be liable for any claim arising out of or related to your use of the Services or any products purchased using the Services, including but not limited to any errors or omissions in any content, or any loss, damage, or injury of any kind incurred as a result of the use of the Services or any content (or product) posted, transmitted, or otherwise made available via the Services, even if advised of their possibility; and for any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including but not limited to loss of profits, revenue, savings, or data, or replacement costs, whether based in contract, tort (including negligence), strict liability, or otherwise.
Section 18 – Indemnification
You agree to indemnify, defend, and hold harmless CourtShield, Shopify, and their affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, or claims (including reasonable attorneys’ fees) payable to any third party arising out of or resulting from: (1) your breach of these Terms of Service or documents incorporated by reference; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.
We will notify you of any claim subject to indemnification, provided that failure to give prompt notice will not relieve you of your obligation unless you are materially prejudiced as a result. We may control the defense and settlement of such claims (including selection of counsel) at your expense, but we may not settle any claim in a manner that imposes any non-monetary obligation on you without your consent (not to be unreasonably withheld). You must cooperate in the defense of indemnified claims, including providing relevant documentation.
Section 19 – Severability
If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the maximum extent permissible under applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service; such determination shall not affect the validity and enforceability of the remaining provisions.
Section 20 – Waiver; Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms of Service does not constitute a waiver of such right or provision.
These Terms of Service, together with any policies or operating rules posted by us on the website or in respect of the Services, constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
Section 21 – Assignment
You may not delegate, transfer, or assign these Terms or any rights or obligations hereunder without our prior written consent, and any attempt to do so is void. We may assign, transfer, or delegate these Terms and our rights and obligations without notice or consent.
Section 22 – Governing Law
These Terms of Service and any separate agreements through which we provide the Services to you are governed by and construed in accordance with the laws of the federal and state or regional courts having jurisdiction over the location of CourtShield’s headquarters. You and CourtShield agree that such courts are the courts of competent jurisdiction and have personal jurisdiction.
Section 23 – Headings
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
Section 24 – Changes to Terms of Service
You can review the most current version of the Terms of Service at any time on this page.
We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to the Terms of Service constitutes acceptance of those changes.
